Your privacy is critically important to us. In order to explain our handling of personal data to you we have established this Privacy Policy for the Equimi Services.

Equimi has a few guiding principles:

We are a small company with a few developers, that are committed to safeguarding the privacy of our website visitors and service users, and simultaneously provide you the best possible service;

We offer you the services to create and manage websites to enhance your presence online as equestrian professional. Any data you store is completely owned by you, and when you decide to remove any or all data associated with your account it will permanently be removed within maximum 45 days;

We provide this service to give people a way to setup a website they can easily manage themselves — without technical expertise being required;

Our business model is a subscription model, also known as SaaS (software as a service), and we don’t sell any of your personal data nor do we share it with any third-parties for reasons other then providing you our services;

1.1. Equimi Services, provided by Equimi Limited and its affiliated companies (collectively referred to as ‘Equimi” and ‘we’), respect your privacy. The personally-identifiable-information we collect and process about you (hereinafter referred to as ‘personal data’) is treated with utmost care and security.

1.3. Our website incorporates privacy controls which affect how we will process your personal data. By using the privacy controls, you can specify whether you would like to receive direct marketing communications and limit the publication of your information. 2. About this policy

2.1. This Privacy Policy (‘Policy’) explains what types of data Equimi collects about you and why, what we do with the data we collect, if and how we share it, the choices, which you have regarding our use of your personal data and how you may access and update it.

This Privacy Policy applies to all offered and operated services and benefits, particularly with regard to our www.equimi.com website, including all subpages, subdomains, successor pages, and the Equimi Web Application (hereinafter collectively referred to as the “Website”) as well as corresponding offers on mobile devices, other technical platforms and on social networks (hereinafter collectively referred to as the “Services”). The Policy does not apply to any website, product or service of any third-party company, even if the Website or Services links to the website of such company. Make sure that you get fully acquainted with the privacy statements of any third-party company before you use their website, products or services and before you provide your personal data to them.

2.3. By making use of the Website and Services you are agreeing to the terms of this Privacy Policy. If you do not agree with the provisions of this Policy, you should not visit our Website or make use of our Services. 3. How we collect your personal data

Equimi collects your personal data in order to be able to provide the Website and Services to you. We collect personal data in two ways:

3.1. When you provide it directly to us. We collect information about you whenever you register and create an account, when you modify your account, when you use, access and interact with our Services. Therefore, information we collect from you includes:

3.1.1. any by you provided personal contact information: name, email address, address, phone number, etc.;

3.1.2. any by you provided profile information: username, etc.;

3.1.3. any by you provided preferences information: notifications, marketing preferences, etc.;

3.1.4. any by you provided content: any personal and company sensitive information that you choose to create, input, submit, upload, store or display in the processes of using our Services, etc;

3.1.5. any by you provided other submissions: information you submit to us as you communicate with us via e.g. third party social media sites, etc.;

3.2. Our Services are designed for you to create and manage webpages on the internet. When you use the Website and the Services. We gather certain information regarding your visits of third-party websites, our Website and the use you make of the Services in order to provide, improve and optimise your user and Equimi experience, which can be categorised as follows:

3.2.3. analytics information: we may collect analytics information such as features of the Services being used, elements of Content related to the function you are performing while using the Services, information regarding your use of the Services and of the downloading functionality forming part thereof, for the purpose of helping us to better understand your preferences and to improve our Services, etc.;

3.2.4. cookies: Equimi uses cookies to allow you access to the Website and the Services, to improve and customise the Services and your customer experience and to understand which areas and features of the Website and of the Services are most popular. For more information on the types of cookies we use and how you can adjust your cookies preferences, please refer to Article 10 below.

4. How we use your personal data

4.1. We use the information we collect about you for a variety of general purposes, including to:

4.1.1. provide, operate, maintain, improve and promote the Website and Services to you;

4.1.2. enable you to access the Website and Services, including to submit, upload and download Content into or from the Services and Website;

4.1.3. process and complete transactions, as well as send you the related information, including purchases confirmations and invoices;

4.1.4. provide customer support services to you, respond to your questions and requests, send you technical or administrative updates and messages;

4.1.5. send you communications with updates regarding the Website, the Services, offers, promotions, and events;

4.1.6. monitor and analyse trends, usage and activities in connection with the Services for marketing and advertising purposes;

4.1.7. prevent fraudulent activities and unauthorised access to the Website or Services;

5. Providing your personal data to others

5.1. We do not share or disclose your personal data or content with any third parties, except as provided under this Policy.

5.2. We work with third-party service providers, which provide website, hosting, application development, payment processing, storage, virtual infrastructure and other services to us. These third-party service providers may have access to your personal data in order to be able to provide their services to us and in doing so we ensure that your personal data is treated in accordance with this Policy. Third-party service providers are prohibited from using the personal data they have access to for purposes other than the ones, which are reasonably necessary for the provision of their services to us. Including:

5.2.1. We use Intercom to be able to communicate with through the online chat, they have their own cookies and information types that they store so as to be able to relay to us the relevant information so we can best serve you. You can find their privacy policy here.

5.2.2. We use YouTube API Services to enable you to search video content from YouTube directly via our Website and Service. While submitting searches you send keywords to YouTube for processing, You can find their privacy policy here.

5.2.3. Other third parties with which we share information include Google Analytics and Adwords. With these we only share non-personally identifiable information and whose purpose helps us improve our Services. Furthermore, we employ the use of third parties to process payments from you, as explained in the Payment Information section.

5.3. The Website and the Services may contain links to other websites, whose privacy practices may differ from our own. If you submit your personal data to any third-party website, your data is governed by their privacy policies. Therefore we ask you to carefully read the privacy statements of any website you visit and consider submitting personal data to.

5.4. We may disclose your data (including your personal data) to third parties if such disclosure is reasonably necessary for the purpose of:

5.4.4. where reasonable, for maintaining, updating or otherwise implementing our data security measures, equipment, technical operations and the like.

5.5. You can create an account at Equimi through the Equimi signup pages throughout the Website and Services. By clicking “I have read and accept the Terms and Privacy Policy” you consent to the Equimi Terms of Use and to this Privacy Policy. Therefore, the data that you fill in the signup page is regulated by the Terms and Conditions and Privacy Policy.

5.6. The Websites and the Services may contain social media features or widgets, such as the Twitter “tweet” button, which may collect information including but not limited to your IP address and the page you are visiting on the Website, and they may set a cookie to enable the feature or widget to function properly. Social media features or widgets are usually hosted by a third party or directly on the Website, and your interaction with them are governed by the privacy policy of the company providing them.

5.7. We may display on the Website testimonials of customer of Equimi, who are satisfied with our Services. With your explicit consent and confirmation we may post your personal testimonial or our Website too, along with your name.

5.8. We may transfer your data (including personal data) in connection with or in the process of negotiating the sale, assignment, or other transfer of the Equimi business or any part thereof, or as part of a security audit.

5.9. We may also share aggregated or anonymised data that does not directly identify you or any of your personal data.

6. Visitors to our website

6.1. For browsing the Website you are not required to provide any personal data to us. We may, however, gather non-personally-identifiable data about you, including but not limited to your IP address, the pages you are visiting on our Website, date and time when you visited our Website. Such non-personally-identifiable data is collected by Equimi for the purpose of monitoring and improving the Website and the Services and is not shared with any third parties or used for the purpose of targeting any advertisements to you.

6.2. Upon visiting the Website you may voluntarily provide your personal data, including but not limited to your name, your email address, and the name of your company, for the purpose of submitting a contact form requesting information from Equimi or for another purpose that allows you to use it if you voluntarily provide your personal data.

7. Storing and protecting your data

7.1. Equimi takes reasonable steps to ensure that all personal data we collect is transferred and stored in a secure manner. In doing so we make sure, as far as reasonably possible, that the collected and stored personal data is protected from misuse, interference, unauthorised access, modification or disclosure. We do so by means of using verified methods including access limitation, industry-standard Transport Layer Security (TLS) encryption technology to safeguard sensitive information, data encryption, and firewalls.

7.2. Data collected by Equimi may be stored and processed in the Netherlands, Germany, France, Ireland. We do not send any information outside the EEA (European Economic Area), unless when it is required to do so in order to provide our Services and process your requests. We uphold and maintain strict procedures for protecting data stored in our servers and access is limited to those employees whose work-related duties involve working with such data. You acknowledge and agree that by providing personal data to Equimi you consent to the transmission of data (including personal data) over international borders, as necessary for processing your requests.

8. Retaining and deleting personal data

8.1. This section sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

8.2. Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. After you remove your accounts or data associated with it this data will be permanently removed within maximum 45 days.

8.3. Notwithstanding the other provisions of this section, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

9.1. You may instruct us to provide you with any personal information we hold about you; provision of such information will be subject to:

9.1.1. the supply of appropriate evidence of your identity (for this purpose, we will usually accept a photocopy of your passport certified by a solicitor or bank plus an original copy of a utility bill showing your current address).

9.2. We may withhold personal information that you request to the extent permitted by law.

9.3. You may instruct us at any time not to process your personal information for marketing purposes.

10. About Cookies

10.1. A cookie is a small file, which is temporarily stored in the memory of your computer or mobile device. Equimi uses cookies to improve the performance of the Website and the Services and to enhance your user experience. 10.2. Strictly necessary cookies: These cookies are needed for the functioning of the Website and the Services, they enable us to identify your device or when you have logged in, and without them the Website cannot function and the Services cannot be provided to you.

10.3. Functionality cookies: These cookies remember information about choices and preferences you have made and allow us to tailor the Website and Services to you and improve your experience.

10.4. Performance cookies: These cookies are aimed at collecting information about how visitors use the Website, including which pages are most popular and whether error messages are encountered on any of the web pages. 11.1. Equimi aims to keep your personal data as accurate as possible. You may at any time correct, update, amend or remove your personal data by contacting us directly, by sending an email to [email protected] or through our chat service on the website. Please note that for the purposes of ensuring the safety of sensitive and personal data, you will be requested to provide sufficient evidence of your identity at the time of your request before any personal data records will be made available to you by Equimi.

12.1. Equimi reserves the right to change this Policy at any time. If we make any changes to the Policy, we will notify you by updating the ‘Effective date’ at the top of this Policy. If any material changes are made to this Policy, we will provide you with and additional notice, such as a notice placed on the homepage of the Website or we will send you and email notification.
